Belarus law

Only found this text about Belarus :

"On State Regulation Of Foreign Trade Activities Law of the Republic of Belarus.
December 29, 1998"

The present Law specifies the legal bases of state regulation of foreign trade activities, right and liabilities of state bodies of foreign trade activities with the aim of insuring the economic safety of the Republic of Belarus, stimulating the development of the national economy when executing foreign trade activities, and provision of the conditions for efficient integration of the economy of the Republic of Belarus into the world economy.

Chapter 1. General Provisions

(...)

Article 14. Prohibitions and Restritions of export and (or) import based on national interests.

Prohibitions and restrictions of export and (or) import of goods, works, services, results of intellectual activities, including the exclusive rights on them, may be established by the President and by the Government of the Republic of Belarus, based on national interests including:
1) observance of public morals and public order;
2) protection of life and health of people, animals and plants, and of the environment in general;
3) protection of cultural values against illegal export, import and assignment of rights thereon;
4) necessity to prevent unpractical use of non-replenishable natural resources, if the measures connected with this are undertaken at the same time with restrictions of the respective internal production and consumption; 5) provision of economic safety of the Republic of Belarus;
6) fulfillment of international liabilities of the Republic of Belarus.
(...)"

Not as precise as the Russian law... Has someone a more precise text ?

And now, as part of the law of Belarus No 218, of March 18, 1997 :

"On Introduction of Bans and Restrictions on Transfer of Goods through the Customs Border of the Republic of Belarus".

2 lists :

"List of Goods Banned for Transfer through the Customs Border of the Republic of Belarus :

(...)

Exporting:

* Wild medicinal raw material

* Plants and animals related to species included into the Red Book of the Republic of Belarus, as well as parts and derivatives thereof (except cultivated or grown in captivity)

* Historical and cultural values *)
*) Historical and cultural values temporarily taken out of the Republic of Belarus to promote international cultural exchange based on the written permit issued pursuant to the legislation of the Republic of Belarus shall not be considered as banned for transfer through the customs border of the Republic of Belarus.

(...)"

* Precious metals and stones in any form and state including jewelry, other household ware, disks for dental prosthetics therefrom and gold-leaf

* Amber, pearl, fumed oak

* Currency value including foreign exchange

* Ores, concentrates and industrial products of precious metals

* Scrap and wastes of ferrous and non-ferrous metals including semi-products and blanks

* Rare and rare-earth metals (elements), goods made from them, their compounds, their scrap and wastes

* Textile and textile goods

* Cultural values defined in accordance with the Regulations on the order of transfer of cultural values through the customs border of the Republic of Belarus

Importing and exporting:

* Nuclear, chemical, biological and other types of weapons of mass-destruction, as well as components of the specified types of weapons.

* Arms and equipment, ammunition and explosive agents for military purposes

* Raw materials, materials, equipment, technologies and scientific and technical information which may be used for developing arms and equipment

* Materials, equipment and technologies which may be used for developing weapons of mass-destruction or delivery vehicles thereof

* Fire-arms of any type of military versions

* Explosive agents and explosive devices of industrial type

* Radioactive emission sources, nuclear substances and materials

* Hunting and sporting arms and ammunition thereto

* Gas weapon and ammunition thereto

* Plain weapon of all types

* Fire-arms simulators using blank charges

(...)"

But nothing really specified on Militaria collectibles... that let place to all interpretations.

why does Ukrainian law prohibit exportation of foreign awards?

On the other hand - technically speaking USSR is a foreign state to the independent Ukraine...

Cultural Items Prohibited for Export from Ukraine

Architectural fragments, sculptures, paintings and graphics irrespective of country of origin made before 1945 (pictures, sketches, etudes, water colors, drawings, original engravings and their replicas, manuscripts).

Fresco paintings and mosaics of all types and their fragments (of antique or archeological origin). Contemporary fine works made after 1945 are allowed for exportation. Ministry of Culture inspection required.

Miniatures made of wood, metal, bone, paper or other material. Contemporary items made after 1945 are allowed for exportation. Ministry of Culture inspection required.

Archeological artifacts and their fragments.

Icons and other religiously related valuables. Contemporary icons and other religious cult goods made after 1991 are allowed for exportation.

Rarities of all epochs made of gold, platinum, precious stones (diamond, ruby, sapphire, emerald, pearls, alexandrine), silver. Valuables produced before 1957 are prohibited. Items manufactured after 1957 are allowed.

Pieces of fine art made of stone: malachite, aquamarine, amethyst, topaz, turquoise, coral, high quality mother of pearl and goods ornamented with them made before 1945 inclusive.

Unique pieces of art made of ivory and walrus bones made before 1945 inclusive.

Gems, cameos, stone stamps, bones and ceramics of precious and non-precious materials made before 1945 inclusive.

National and foreign coins and collections of coins of precious and non-precious metals, bills, money erzats produced before 1960 inclusive.

Postal stamps and collections of postal stamps printed before 1970 inclusive.

Books and manuscripts translated in ex-USSR national languages before 1925 inclusive. Foreign printed books before 1880 inclusive. Foreign books and manuscripts printed from 1880 till 1945 only by permission of the Ministry of Culture. Multi volume encyclopedias, special edition handbooks and dictionaries only by permission of the Ministry of Culture.

National and foreign awards, decorations, pins (badges) and medals (with some exceptions). Exportation is allowed only if you possess proof of ownership for the awards bestowed on you or your direct heirs.

All types of national and foreign made firearms and cold steel arms manufactured before 1945 inclusive. Note that for modern firearms you must have special permission, please address this issue to RSO.

National and foreign made fine, household and scientific devices and tools made before 1945 inclusive (watches, barometers, scales, binoculars, monoculars, samovars, flatware, silverware, etc.).

National and foreign fine arts and goods made of china, pottery, ceramics, majolica, glass, crystal, beads, stone, horns, skin, bronze, copper, enamel, iron, cast iron, steel, cupronickel, tin, ornament silver, wood, lacquers and other materials created before 1945 inclusive.

National and foreign fine clothes articles, footwear and folk wear, unique fine works made of tissue before 1945 inclusive.

National and foreign wallpapers, tapestry, hand woven carpets and carpet works, hand weaving articles, fine embroidering made before 1945 inclusive.
Ancient and modern keyboard musical instruments produced by foreign manufacturers and masters: grand pianos and pianos, clavichords, physharmonicas, etc. National musical instruments made before 1945 are prohibited. National musical instruments made from 1945-1960 are allowed with Ministry of Culture permission. Those made after 1960 are allowed for exportation w/o permission. Foreign made instruments manufactured before 1920 are prohibited. Instruments made after 1920 only with Ministry of Culture permission.

National and foreign made antique furniture manufactured before 1945 inclusive. Some series or individual furniture made from 1945 till 1960 may be exported with permission of the Ministry of Culture.

Fine pieces of folk arts made before 1945 inclusive.

National keyboard, wind, bowed, ligulated and drum instruments manufactured before 1945 inclusive.

Bowed musical instruments made by known masters (especially by Italian and French masters and firms). Instruments manufactured before 1960 are prohibited for exportation. Those made after 1960 are allowed with Ministry of Culture permission.

Italian and French-made Accordions manufactured before 1960 inclusive. Accordions made after 1960 are allowed for exportation. Master crafted accordions made after 1960 exportable with Ministry of Culture permission.
Foreign made harps and wind instruments.

Antique national and foreign musical instruments as well as outstanding modern folk instruments made by known masters.

Vinyl plastic records produced before 1960 inclusive.

Original copies of tape recordings from a long term recording storage fund.

Maybe it's for foreign awards that were awarded to Ukrainian citizens.
And are part of an award group.

Forbidden to export:

* Weapons.

* Narcotics.

* Invalidated valuables.

* Any Russian orders or medals .

* Books, videofilms and other items which can inflict harm on any foreign state.

Those trying to export prohibited items and not declaring them should expect the worst of all. In these cases, besides the confiscation, one has to pay a fine ranging from 100 % to 300 % of the items' cost.

If undeclared prohibited items are found in any secret or hidden section inside your suitcase, for example laying between the bottom layers of the suitcase, or if you have tried to export many of the banned items, then your actions are regarded as deliberate breaking of customs regulations and persecuted as a crime.

Banning Export of Foreign Awards

I would think the ban on the exportation of foreign awards is aimed at those who would use Ukraine as a base/platform from which to smuggle third country items out. Given the relative ease of movement (still) between many of the former Soviet republics, I should think it easier to move things across CIS borders than across CIS/EU borders. Couple this with the fact that Russia has real (Ukraine, Georgia, Moldova etc) or de facto (Transnistria) military bases/deployments in several former Soviet republics, "foreign" awards are relatively plentiful throughout the CIS. As such, I think the ban on the export of foreign awards seeks to eliminate trafficking of these awards through Ukraine.

I have a question. If no orders and medals are allowed to be taken out from Russia, how do dealers manage to get them out? (My dealer receives all his stuff from St Petersburg to Santiago but he didn´t tell me how!)
